The Supreme Court is clearly defined in our constitution. It is an essential part of our Republic’s balance of power. The Congress is the legislative branch and is responsible for passing laws. The President is the executive branch and is responsible for running the government and enforcing the laws passed by Congress. The Supreme Court is the judicial branch and its sole responsibility is to guarantee the Constitution and to make sure that the laws passed by Congress are not violated.
The
Supreme Court currently has nine Justices which is a good number. It should never be an even number which could
lead to dead-lock decision. When there
is a vacancy on the Supreme Court, the Constitution is clear on how that
vacancy is filled. The President is to
name a replacement, and the Senate is to confirm or deny that nominee.
The
President has a Constitutional duty to name a replacement to fill a court
vacancy so there is not an even number of Justices. This is not negated by where a president is
in his/her term. A President is elected
to a four-year term and is expected to do the job for that entire four-year
term. Presidents have named replacements
to fill Supreme Court vacancies after they have lost their bid for election to
a second term.
This
process should not be a partisan process, considering the Constitutional
definition of the Supreme Court.
Unfortunately, it has become a partisan issue in today’s highly divided
political climate. If one party holds
the White House and a majority in the Senate, the process is easier and
smoother.
All
Supreme Court Justices have one duty and only one. That duty is to enforce the Constitution with
its Amendments and the laws passed by Congress.
There should never be a political activist with any other agenda on the
Supreme Court. Democrats want to ignore
the Constitution for partisan reasons.
Justice
Ruth Bader Ginsburg’s has passed. The
President has a Constitutional duty to submit the name of a replacement to the
Senate. Part of her popularity with
liberals was that she was a political activist.
Much of her agenda was good, but it had no place in the Supreme
Court. Unfortunately, we have some other
justices that are political activists on the court now. Since a Supreme Court Justice is appointed
for life, we will have to live with them for years to come. But, new appointees should not let partisan
agendas influence their vote.
Democrats
are currently trying everything they can think of to promote fraud, disrupt,
delay, and discount the upcoming 2020 election.
These tactics could mean the results of the election could end up in the
Supreme Court. If the vacancy is not
filled, there could be a split decision, and the country could be in total
chaos with a total economic collapse and anarchy in the streets.
Trying
to influence to Supreme Court or pack it with liberal Justices is nothing new
as the radical Left wants to eliminate the Constitution and the rule of law in
order to destroy the country and rebuild it from the ashes. We have to stop this at the ballot box in
November.
