The Fourth Amendment

        The Fourth Amendment protects us from unreasonable search and seizure.  This probably has different meanings for everyone depending on what is important to them personally.  Let’s be honest, we are not concerned about personal liberties and right being taken away if they are not important to us personally.  The Fourth Amendment reads as follows:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the person or things to be seized.”

        We now have a situation where the National Security Agency has collected information like individual’s e-mail information without a Warrant.  I don’t see the difference from opening and copying your snail mail.  The NSA claims this action is justified for two reasons.  They say it is necessary for national security against terrorism and secondly they say the information is just collected and will not be used or read without a proper Warrant. 
        These reasons do not hold up to reasonable scrutiny.  If the information is not read or analyzed without a Warrant, why collect it as it can be collected and analyzed after a Warrant is issued.  What is the problem? Some people say it might help prevent a terrorist attack, so why not collect it.  After all the government says they won’t read it with out a warrant anyway.  Is anyone naive enough to think we can trust the government not to use this information for political purposes after the IRS incident?
        What really irritates me is we know the profile of most terrorists, but we can’t profile them because that would infringe on their civil liberties.  So instead the government infringes on everyone’s constitutional rights.
        Benjamin Franklin said; “They who give up essential liberty to obtain a little temporary safety deserve neither liberty or safety.”  I think he was right, and people who give up essential liberty will eventually have neither liberty nor safety.  Our founding fathers were so smart. 
        “Power corrupts and absolute power corrupts absolutely.”  This phrase is generally credited to Lord Acton in 1887.  Too strong a federal government was the number one concern with our founding fathers and I can certainly see why. 
        Some people say the constitution is outdated and needs to be a “living” document.  Personally, I think this is just an excuse for people when it does not fit their political agenda.  The Fourth Amendment does not specifically address the Internet, but it does not specifically address your vehicle either.  So if we go down this road, where does it stop?  Can the government collect all your banking records too?  Of course, they wouldn’t look at them without a Warrant.  Sorry, bad example as that may be already happening when Obama Care is fully implemented. 
        We better take a lesson from our founding fathers about the dangers of big government, or we will eventually lose our freedoms and safety to the political elite.  Does the political elite really know what is best for us?

Equal Justice For All

  
        I advocate equal justice for all.  I do not like to see individuals or special interest groups getting special considerations or privileges.  It seems like Hollywood celebrities, sports stars, the super rich, and the political elite do not think the laws apply to them.  If most of us break the law and are caught, we expect to pay the price.  Why do the privileged in our population not think they should face the same consequences? 
        Hollywood Super stars seem to always be in the news, and never seem to face the same consequences as the rest of us. Jane Fonda is one of the oldest examples I remember personally.  She went to Hanoi, North Vietnam and met with the communist military leaders we were fighting.  She was shown American prisoners and betrayed their trust so they were beaten and some even died.  This was obviously not done with the approval of our government or military.  Ms Fonda now admits it was probably the worse mistake she ever made in her life, but she was never held accountable.  She never faced any charges and the fact that she caused the death of American military personnel never seemed to even affect her career.  She probably should have been tried for treason with a potential penalty of death. 
        Sports are a big part of our culture and some of the sports celebrities do not think the law applies to them.  O.J. Simpson is one of the most extreme examples.  Many people feel he got away with murder.  We hear of new examples almost every day.  These sports heroes should be setting examples for our youth and not giving the impression the law does not need to be observed.
        In the Nixon/Frost interviews, President Nixon said, “It’s not illegal if the President does it.”  This seems to be the attitude of some political elite today.  The other excuse is that it is okay to lie, cheat and break the law if “it’s just politics”.  This has got to stop. 
        Nixon resigned the Presidency for covering up what I would almost call a political prank.  Now we have multiple political scandals and cover-ups where Americans sometimes died.  If anyone would have told me a decade ago that the Internal Revenue Service, the Department of Justice, and the National Security Agency could or would be used for political purposes, I would have said it can never happen in this country.  Now we know better.  Were laws broken?  Were civil rights abused? Was the Constitution ignored? Amazingly the political elite denies any knowledge of what was happening.  Who’s running the government? 
We hear about people resigning or people that should resign.  When someone resigns or is fired, they seem to face no additional consequences and the cover-up continues.  I don’t want to see anyone get fired or resign.  I want to see the people responsible go to jail.

Right is Right and Wrong is Wrong

        I have had it with partisan justification.  When someone from either party does something wrong, the party loyalists defend them, or say someone from the other party did worse, or blame the other party as conspiracists, or say the accusations are politically motivated, or say the media is playing political favorites.  I know all of these things happen, but when is doing something wrong just plan wrong. 
        I am just sick of the party politics.  People lie, cheat, bend the rules, break the rules, and even break the law, and it is condoned and covered up because, It’s just politics.  Everything seems to be about party politics and getting reelected.  When are “We the People” going to say we have had enough?
        Maybe it is time for term limits for all elected state and federal offices.  Some politicians say they support term limits, but this usually changes once they are in office.  Michelle Bachman is one that supports term limits and acts accordingly.  She says eight years is enough and is not running for the US Congress again.  Some people love her and some hate her, but with respect to term limits, she does what she says.  Some people say she is not running because she does not think she could win.  That is just more partisan political BS in my opinion.  
        Term limits might help with the problem.  I have mixed emotions as I can see a benefit with career politicians, but career politicians seem to promote corruption, and increase big government and the political elite ruling class.  I think the only real solution is when “We the People” say we demand honesty, and transparency in government.  Right is right and wrong is wrong.  It should have nothing to do with politics.  Let’s face some facts.  Transparency in government has become a bigger issue in the last few presidential elections and we obviously have gone in the wrong direction. 
        As I mentioned last week, we have the IRS scandal, the Benghazi tragedy, Fast & Furious, freedom of the press infringement, voter intimidation, and more, and no one takes responsibility or seems to know anything.  We must demand all government servants do what is right.  We must stand up for our country and freedom, and not just the things that affect us personally.
